i'm trying to get out of my lease for my apartment i'm at now its NOT safe here for kids. i've been here since march and signed a 1 year lease. i have a baby on the way and 2 year old son. i got a eviction notice today saying if i don't pay rent by tomorrow morning then there sending my file to an attorney. my question is does most apartment complexs check your credit? my credit right now is 545. i plan on going to another apartment tomorow and applying i know i can get the apartment i'm just worried there turn me down due to my credit. i've never paid my rent late either its only 9 days late and there already threatening eviction on me.

The credit is not that good, but you will get an apartment. Quite frankly, you may want to try and buy a house - try an FHA loan - it only requires 2% down. Yes, you can get a house at 545 - but you will pay a higher interest rate than you otherwise would.
I suggest this route - because home ownership, if you can keep from going 30 days late - will improve your score after about a 6 months or so, and will keep helping you out. Plus you will be building equity.
As to your landlord, that's a typical reaction - it may sound unfair, but it's a common practice to limit the amount of "free" rent they end up giving away from deadbeats (and I'm not including you in this category). Just a reality - if the rent is not paid on the 1st, file papers right away. Think about it if you were the landlord and you needed the money - you'd behave the same way. Another reason you should own your own home, you get about 15 days before they start panicking - just don't make a habit of it.
In your case, document why you are leaving and do so. Take pictures. You may need it when they take you to court. They may back off if they see you are prepared to fight them.
If you are going to do this you should do it before they start eviction proceedings, so that the eviction won't show on your report. Furthermore if the apt is not safe because of the actual complex (ie loose stairs, missing hand rails, ruts in the sidewalk) you have grounds to leave your lease. It is not uncommon for a leaser to start eviction proceedings quickly like this. They know that if they wait the judge will rule for the tenant stating that they leaser set a precedent of letting them pay late with no repercussions.
I won't sugar coat things, 545 is bad, very bad. But these days your credit rating isn't everything. If your rental is well under the 1/3 of your monthly income level you should be OK. Most likely you will be what is called "conditionally approved" and you will have to pay a large deposit (anywhere from double the security deposit to 1st and last month's rent plus deposit).

Yes that is considered bad credit. Perhaps trying to rent from and individual. Remember first appearances count when searching. I feel these days thats all that matters is a persons credit score as if it is going to be scribed on our tombstone. We are the more than the sum of our debt. Good luck.
