Question:
My husband has terminal cancer and has been given 4 months to live. Am I responsible for debts that do not have my name on the accounts (such as medical bills, personal loans, and mortgages).
Answers:
If it's a community property state then yes. However, I don't see how this is enforceable if your name isn't on the contract(s).
Those debts will be paid from his estate.
Anything left in his estate will be divided by the will & probate.
If the estate does not cover the debt, you are only responsible if it is a joint account.
In the US , if you are legally wed , you share all assets and liabilities (debts) .
Other countries , I don't know .
Yes. As his wife, you are his next of kin. I think the only way this is different is if he left a will giving everything to someone else. In that case, I think that person also inherits his debt.
If your name not on this accounts, you are absolutely not responsible for any of them,When you start getting statement or collection calls, just send them a d.. certificate.
I'm very sorry about your husband.
