Question:
I am married and need to file bankruptcy. My husband does not want to do it but I have to because I cannot keep up with my bills. How will it affect him on the bills we have signed together on and what is the process??
Answers:
Depends on if you live in a community property state. Just because you file doesnt mean it affects him. Find out if you are in a community property state. Any joint bills you have you can reinstate so it wont hurt his credit. Call an attorney they 30 minute free consultation will answer all these questions.
But it probably wont affect him if you are the only one on the loans.
Best wishes
It depends on the laws of the state you live in. In MY case, we were living in New York state, and I had to file a petition for exclusion from proceedings (because he was in the military and it would have damaged his clearance).
Check with your local civil courthouse... or google it.
Good luck!
Everything that you and your husband signed together will show on his credit as "Included in bankruptcy of other person".
You can reaffirm on these accounts and keep paying them, but you will need to call every lender and request that they continue reporting to the credit bureaus.
When you first file chapter 7 every debt must be included and then you decide which ones you want to reaffirm. This is why you must call and request that they continue to report. If you do not, they will report as I stated above.
